Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your use of the SecureKy Discord bot, web dashboard (panel.secureky.eu), marketing site and related features (together the "Service").

By inviting the bot, using the dashboard or otherwise interacting with the Service, you agree to these Terms and our Privacy Policy (/privacy).

If you are under 16, you may only accept these Terms with permission from a parent or guardian.

2. Who we are

The Service is provided by SecureKy, operated by Kylian's Car Service (sole proprietorship, trade name Kylian's Hosting Service), based in the Netherlands.

SecureKy is not an agent of Discord Inc. and is not affiliated with Discord, Twitch, YouTube, TikTok or other platforms.

3. What you get

The shared SecureKy bot is mostly free. All modules can be enabled per server via the dashboard — there is no paywall for individual core modules.

Optional premium subscription (see section 12) adds branding extras, such as hiding "powered by secureky.eu" in Discord presence.

You may also place your own bot token in the dashboard ("custom bot"); that bot runs on our worker with your name and avatar under these Terms.

Features may change, be added or removed. SecureKy is under active development (open beta).

4. Server owners and GDPR

If you add SecureKy to your Discord server, you are often the data controller for your members' data. SecureKy then provides tooling and configuration as a processor on your behalf, as described in the Privacy Policy.

You remain responsible for server rules, moderation, permissions and legal compliance (including GDPR) toward your members.

5. Acceptable use

You must not use the Service to break laws, infringe others' rights, distribute malware, disrupt the Service or gain unauthorized access.

Prohibited conduct includes: spam, harassment, hate speech, threats, illegal content (including CSAM, piracy), circumventing anti-scam protection, collecting personal data without consent, and activities contrary to Discord Community Guidelines or Discord Terms of Service.

Reverse engineering or copying our software is not allowed except where mandatory law permits under EU Software Directive 2009/24/EC (interoperability).

Automated abuse (scraping, excessive API calls), reselling or sublicensing the Service without written consent is prohibited.

Violations may result in revoked access to the bot, dashboard or specific servers, or a global ban.

6. No warranties (as-is)

The Service is provided "as-is" and "as available" without any warranty. Specifically:

No uptime guarantee — the bot or dashboard may go offline.

No data retention guarantee — backups are best-effort; guild data is retained after the bot leaves per the Privacy Policy and retention settings.

Features may change, pause or disappear without prior notice.

Anti-scam and moderation catch a lot but not everything — use common sense.

Stream alerts, status and integrations depend on external APIs (Discord, Twitch, YouTube, TikTok).

7. Liability

To the extent permitted by law, we are not liable for indirect damage, consequential loss, lost profits, data loss, actions by moderators or users in your server, scams that slip through security, or downtime of Discord, hosting or other third parties.

Our total liability for direct damage is limited to amounts you paid us in the twelve months before the incident — for free use that is zero euros, unless mandatory law provides otherwise.

This limitation does not apply to intent or gross negligence on our part, nor where mandatory law prohibits limitation.

8. Indemnification

You indemnify SecureKy against third-party claims arising from your use of the Service, your server content or breach of these Terms or law, to the extent permitted by law.

9. Virtual currency (economy)

The optional economy module uses a virtual currency ("coins" or a name chosen by the server admin).

Coins are a closed virtual currency with no monetary value. They cannot be exchanged for money or goods with monetary value and cannot be cashed out.

Coins are not transferable outside SecureKy and do not represent ownership, credit or a claim.

We and server admins may adjust, reset or wipe balances at any time (e.g. abuse correction or technical migration) without compensation.

10. Coinflip and entertainment

The /coinflip command (and similar entertainment using virtual coins) uses only the virtual currency from section 9.

There is no real stake or cash prize — this is not gambling under applicable gambling law.

Server admins can disable the economy module per server. We recommend disabling entertainment for young audiences.

11. Twitch linking (optional)

Linking a Twitch account to Discord is fully optional and per Discord server.

Link: /twitchlink in Discord, then !link <code> in Twitch chat (see module documentation).

Unlink: /twitchunlink in Discord or !unlink in Twitch chat. Links are also removed on bot removal or guild data purge.

The bot may post messages in Twitch chat on behalf of the streamer when the Twitch chatbot module is active. See the Privacy Policy for data processing.

12. Premium

Premium is optional and adds among other things: hiding powered-by branding (hide_branding) and multi-activity presence (multi_activity), as shown under Subscriptions in the dashboard.

Billing and payment are handled outside the bot. Premium servers with an active subscription on assigned_guild_id are not auto-purged while the subscription is active (see Privacy Policy).

Prices and features may change; existing subscriptions will be informed in advance where required.

13. Custom bot

(a) Your own bot token via dashboard: you provide your Discord Application token; SecureKy runs a worker with your branding. This falls under these Terms and the Privacy Policy.

(b) Bespoke bots, dedicated workers or quote-based projects are outside these standard Terms. Separate commercial agreements apply via contact@secureky.eu.

You are responsible for complying with the Discord Developer Policy and for what your custom bot does in servers.

14. Intellectual property and AI-assisted development

The SecureKy bot, dashboard, branding, code and documentation are protected by intellectual property rights. You receive a limited, non-exclusive license to use the Service as intended.

Parts of SecureKy were built with AI tools and then reviewed and tested by humans. Errors may still occur. This does not replace an independent security audit or legal advice.

15. Abuse reports

Suspect abuse, rights infringement (copyright, trademark, portrait rights) or other violations via SecureKy? Email security@secureky.eu with description, location (server, channel, message) and contact details.

See also /security on the marketing site. We aim for an initial response within 14 days (best-effort).

16. Termination

By you: remove the bot from your server and stop using the dashboard. Data deletion follows the Privacy Policy.

By us: we may revoke access for abuse (section 5). For serious abuse (including CSAM, illegal activity, systematic scams) this may be without prior warning; for less serious violations we try to warn first.

17. Changes

We may update these Terms. The date and version at the top show the latest change.

Minor changes (clarifications, typos): take effect immediately; continued use counts as acceptance.

Material changes affecting your rights: we notify server owners at least 14 days in advance via DM (shared or custom bot), a notice in the dashboard and on the marketing site.

18. Service shutdown

If SecureKy is discontinued, our intent is to notify server owners in advance, publish source code on GitHub so others can continue hosting, and provide best-effort migration help on request (including early source access to reduce downtime).

No guarantee on timing or completeness — this describes our intent. Personal data processing stops per the Privacy Policy.

19. Governing law, disputes and contact

These Terms are governed by Dutch law, unless mandatory consumer law in your country of residence (within the EEA) is more favourable.

We try to resolve disputes amicably first. EEA consumers may use the EU ODR platform: https://ec.europa.eu/consumers/odr

For non-consumers, the Amsterdam District Court and Dutch law apply, unless mandatory law provides otherwise.
